The Gowing Bros Ltd mobile message service (the “Service”) is operated by Gowing Bros Ltd (“Gowing Bros Ltd”, “we”, or “us”). Your use of the Service constitutes your agreement to these Mobile Terms. We may modify or cancel the Service or any of its features at any time. If we make material changes to these Mobile Terms, we will notify you as required by law, and your continued use of the Service following such notice constitutes acceptance of the updated terms.
1. Consent & Participation
By expressly opting in to Gowing Bros Ltd’s SMS/text messaging service (e.g. by checking a consent box or entering your mobile number and confirming), you give express consent to receive recurring SMS/text messages from and on behalf of Gowing Bros Ltd through your wireless provider to the mobile number you provided.
Promotional messages may include promotions, specials, and other marketing offers. Message frequency varies, but you can expect up to 5 messages per month.
Your participation is voluntary, and your consent is not a condition of purchase. You may withdraw your consent at any time (see “Opt-Out” below).
2. Charges & Responsibility
We do not charge for the Service, but you are responsible for any charges imposed by your wireless provider. Message and data rates may apply. Check your plan and contact your carrier for details.
3. Identification
Every message you receive will clearly identify Gowing Bros Ltd or Coffs Central Shopping Centre as the sender and include a way to contact us or opt out.
4. Opt-Out & Unsubscribe
You may opt out of the Service at any time by clicking the unsubscribe link included in every marketing message.
You will be taken to a page to confirm your choice and will receive a one-time confirmation of your unsubscribe request. We will honour your opt-out request within five (5) business days as required by the Spam Act 2003 (Cth).
The opt-out mechanism is functional, free of charge, and does not require logging into an account. It remains active for at least 30 days after each message is sent.
If you have subscribed to other Gowing Bros Ltd messaging programs, you must opt out of each program separately.

6. Number Changes
If you change your mobile number, you must sign up again with your new number. We will take reasonable steps to ensure STOP/HELP requests are processed even if we update short codes or sender IDs, and we will notify you of such changes where practical.
7. Do Not Call & Legal Compliance
We comply with the Spam Act 2003 (Cth) and Do Not Call Register Act 2006 (Cth). We will not send messages to numbers on the Do Not Call Register unless we have valid consent.
8. Liability
To the extent permitted by law, we are not liable for any delays or failures in message delivery. This clause does not limit your statutory rights under Australian Consumer Law.
9. Privacy
We respect your privacy. See our Privacy Policy for how we collect, use, and store your information, including mobile numbers and marketing preferences.
10. Record-Keeping
We maintain records of consent (who, when, and how) and will provide evidence of consent if required by the Australian Communications and Media Authority (ACMA) or other regulators.
